Your personal data (name, surname, address, tax identification number, IBAN etc.) are processed a) to allow you access to the event and b) manage any communications relating to the COVID emergency. The legal basis of the processing relating to the purpose a) is the fulfilment of contractual and regulatory obligations, as well as the execution of pre-contractual measures adopted at your request, while the legal basis for the purposes b) is the compliance with a legal obligation to which the controller is subject. In detail, the implementation of the anti-contagion security protocols pursuant to art. 1 n. 7 lett. D) of the DPCM of 11/03/2020 and the “Shared regulatory protocol for measures to fight and contain the spread of the COVID-19 virus in the workplace” and subsequent amendments and additions

To execute the relationship between the parties, we are authorized to communicate your data to (a) subjects identified as legal or tax consultants, IT service providers, third party companies that collaborate in the management of certain activities of the event (for e.g. ticket office) that have received a formal assignment from us and have been named “Data Processors”. A list of Data Processors is available at our offices; (b) subjects identified as banking and financial institutions, Public Authorities and Administrations. SALE OF DIGITAL PASSES TO DIGITAL EVENTS

Purchase contract

The user who uses the service is obliged to respect all the general conditions contained in these regulations. It must therefore be read and approved in all its parts before proceeding with the purchase. The service for the sale of admission tickets to digital events (hereinafter referred to as "Service") is provided by Fiera Bolzano Spa, headquartered in Piazza Fiera 1 - 39100 Bolzano, Tax Code and VAT number 00098110216 (hereinafter referred to as "Fiera Bolzano").

Object

The purpose of the Service is the online sale of tickets valid for access to digital events that can be enjoyed online (hereinafter "Digital pass"), organized directly or indirectly by Fiera Bolzano on its own or third party platforms. In providing the Service for events organized by third parties, Fiera Bolzano acts on behalf of the Organizer of the event and has no responsibility in the management and organization of the events, which may change independently from the will of Fiera Bolzano, which only carries out a periodical monitoring of the update of the information published upon direct input from the Organizers of the events. The online publication of these General Terms and Conditions and the confirmation of the purchase order provided by Fiera Bolzano to the Consumer are valid as "confirmation of the contract concluded on a durable medium" pursuant to art. 51, paragraph 7 of Legislative Decree no. 206/2005 ("Consumer Code").

Admission tickets for events organized by Fiera Bolzano

The admission ticket must be purchased through the sales channels of Fiera Bolzano or from a party authorized by Fiera Bolzano to sell admission tickets. The admission ticket may not be transferred by the customer for a consideration and may not be intermediated. Fiera Bolzano may cancel an admission ticket which has already been issued at any time for technical and/or organizational reasons or if problems arise with regard to the actual payment of the admission ticket by the customer. Fiera Bolzano is responsible for any changes in the program of events published and organized directly.

Admission tickets for digital events organized by third parties

Fiera Bolzano is not responsible for the type of seats offered for sale by the Organizer and does not guarantee that the Digital passes available through its sales channels represent the best available for each type at the time of purchase by the Customer or that better seats cannot be offered for sale by the Organizer at a later date. Furthermore, Fiera Bolzano cannot be held responsible in any way for any inconvenience, inconvenience or disservice suffered by the user of the Service managed for third party events, for facts due to the Organizer of the event and in the case of cancellation or postponement by the Third Party Organizers of the event for which Fiera Bolzano has provided the Digital pass. The reimbursement of the relative price must be requested directly from the Event Organizer. Fiera Bolzano can in no way be held responsible for any changes in the program of events organized by third parties. To this end, it is recommended to always check the scheduled events directly on the official website of the relevant Event Organizers. The price of the Digital pass is the one communicated by the Organizer and known to Fiera Bolzano at the moment of the closing of the purchase transaction of the Digital pass by the Customer. Any lower price that may be applied by the Organizer to Digital passes of the same type or to Events to be held on a particular date after the purchase by the Client will not entitle the Client to a refund of the difference.

The Service allows the user to have a limited period of time to pay for the tickets booked (hereinafter the "Booking Time"). The Reservation Time is specified in the pages of the Site dedicated to the event and is equal to 20 minutes. Once the Reservation Time has elapsed without the user having made payment for the tickets booked, the relative reservations will be cancelled and all the seats will automatically return to the sales circuit. It should be noted that, depending on the different agreements that Fiera Bolzano stipulates from time to time with the Event Organizer, the latter may reserve the right to withdraw, at any time and at its own discretion, from the Sales Service seats for access to published events. In this case, if at the time of withdrawal by the Event Organizer the user has not yet completed the purchase of the relative admission ticket and consequently the relative reservation is still valid according to these general conditions of use of the Service, since the Reservation Time has not yet expired, it will no longer be possible to retrieve the reservation, even if valid, and the relative admission ticket cannot be issued by Fiera Bolzano, without Fiera Bolzano being in any way responsible for this.

Payment instruments

The fees can be paid exclusively through the PayPal circuit, also with credit cards belonging to the VISA, VISA ELECTRON, MASTERCARD, AMERICAN EXPRESS circuits, through the KeyClient payment system for online transactions. Commissions and/or further charges may be applied to the Customer, which in any case will be explained to the Customer during the purchase process. Fiera Bolzano reserves the right to apply, for security reasons or at the discretion of the Event Organizer, limitations and exclusions to the payment instruments that can be used by the Customer for the payment of the purchased Digital passes. Payment is made through a virtual counter in secure mode with irreversible 128-bit encryption. By means of this method, the transaction takes place exclusively within a banking system and the Bolzano Fair has no access whatsoever to the credit card data of the buyer.

Price of admission tickets and service fees

The price of the admission tickets is the one indicated on the event's reference website, including any pre-sale fees applied. Fiera Bolzano may apply, on each sale transaction and as remuneration for the Service, service commissions according to the agreements with the Organizers and, in any case, at its own discretion. These commissions are explicitly highlighted in the most appropriate manner in relation to the different sales channels used by Fiera Bolzano. The price of the admission tickets, as well as the service fees, and any other price displayed on the Site must be understood to include the applicable VAT.

Sending of admission tickets

The purchased admission tickets will be sent by email to the Customer at the email address indicated during the purchase process. Fiera Bolzano allows the Customer to retrieve the Digital pass to access the event, in case the Digital pass has been lost, through the online reserved area. The Service reserves the right to cancel bookings that are not complete or not paid.

Right of withdrawal

Pursuant to art. 55, paragraph 1 letter. b), of Legislative Decree 6 October 2005 n. 206 (the so-called "Consumer Code") to transactions made through the Service is not applicable to the exercise of the right of withdrawal referred to in Articles. 64 et seq. of the Consumer Code. After the transaction has been carried out, it is therefore not possible to cancel the purchase or have the nominal price refunded. Fiera Bolzano is not authorized to refund or replace the purchased admission tickets and in case of an event cancelled or postponed by Third Party Organizers, the user will have to apply exclusively to the Third Party Organizers of the events in order to request the refund of the face price of the admission tickets purchased through the Service, without prejudice, however, to Fiera Bolzano's right to retain its own sales commission rights.

Prohibitions

Admission tickets may not be used for political reasons, unless prior written authorization has been obtained from Fiera Bolzano and, in the case of a third party event, from the Event Organizer. Any customer who uses Access Certificates in violation of this provision will be liable for damages resulting from their conduct and may be prosecuted.

General

Even in the event that any of the rules contained in these General Terms and Conditions are inapplicable, the others will continue to have full effect. In all other cases in which the user of the Service is not a consumer, any dispute regarding the validity, interpretation, execution and/or termination of legally relevant acts related to the use of the Service shall be submitted to the exclusive jurisdiction of the Court of Bolzano. These General Terms and Conditions, the various provisions indicated in the phases of the distance selling process, where applicable, and the warnings on the Access Title constitute the entire contractual agreement between the Customer and Fiera Bolzano. In case of conflict between the provisions of these General Terms and Conditions, as published in Italian, and the corresponding text published by Fiera Bolzano in German or English, as well as in case of conflict between the Italian version and the German or English version of any other content of the Contract, the Italian version shall prevail.

SALE OF TICKETS FOR ONSITE EVENTS 

The data collected on this site are processed by: 

- M.I.D.A. Informatica Srl, supplier of the MidaTicket service, to manage the service of selling and sending event tickets together with the assistance service (by phone and email) and complaint management. 

- Fiera Bolzano Spa, as organiser of the event, for organisational and security purposes, to offer the assistance service (telephone and email) and complaints management and, only after having collected the relative optional consent, for marketing purposes. 

The purpose of the service is the online booking and pre-sale of tickets valid for access to events carried out by Mida on behalf of Fiera Bolzano SpA. All admission ticket holders must have a valid admission ticket to access the event venue. The rules applicable to the customer as communicated in relation to the individual event apply to them. In the event that the entrance ticket has been purchased by the customer from parties other than those indicated above, or if the entrance ticket has been lost, stolen, duplicated or obtained in contrast with these General Contract Conditions, the entrance ticket holder may not be authorised by Fiera Bolzano SpA to enter the event venue or may be obliged to abandon it. Mida will not replace the entrance tickets to the selected events handed over to the user, in case such entrance tickets are lost, deteriorated, damaged or destroyed or if they are stolen. 

The admission ticket required for admission, whether in paper or digital form, is strictly personal and may not be transferred by the Customer for payment or brokered. (If the customer is requested to print at home or to manage the admission ticket in digital format, the user must adopt all the specifications indicated on the purchase procedure in the section dedicated to the event on the Website). 

MidaTicket can cancel at any time, upon request of Fiera Bolzano SpA and/or of the authorities in charge of the protection of public order and safety, an admission Ticket, even if already issued, or a purchase order already made, both for technical and/or organizational reasons and in case of problems with the effective payment of the admission ticket by the customer. In case of inconveniences or inefficiencies suffered and in case of cancellation or postponement by Fiera Bolzano SpA for which MidaTicket has provided the admission ticket, the reimbursement of the relative price must be requested directly from Fiera Bolzano SpA which will choose the modalities for a possible reimbursement of the pre-sale right. 

The fees for the purchased admission tickets can be paid exclusively through credit cards belonging to the VISA, VISA ELECTRON, MASTERCARD, AMERICAN EXPRESS circuits, through the KeyClient payment system for online transactions and through PayPal; even in the event of a refund, the fee will be paid directly to the payment method used, within the timeframe foreseen by the banks and the service platform. 

Payment is made through a virtual counter in secure mode with irreversible 128-bit encryption. By means of this method, the transaction takes place exclusively within the banking system and the Mida company has no access whatsoever to the purchaser's credit card details and personal PayPal account. 

The price of the admission tickets is the price shown on the admission ticket itself, including any pre-sale rights applied by the organiser. The price of admission tickets, as well as the service fees and any other price displayed on the Site must be understood to include the applicable VAT. 

The Service reserves the right to cancel reservations that are not complete or not paid for. Pursuant to art. 55, paragraph 1, letter b) of the Legislative Decree no. 206 of 6th October 2005 (the so-called "Consumer Code"), the right of withdrawal as per articles 64 and following of the consumer code is not applicable to transactions made through the MidaTicket Service. After having carried out the transaction, it is therefore not possible to cancel the purchase, nor to have the nominal price refunded.

The way we process your data

Your data is processed with or without the help of automatic processes and includes all the necessary ways necessary for the adequate processing, such as the collection, the registration, the organization, the structuration, the storage, the adaptation or the modification, the extraction, the consultation, the use, the communication by transmission, disclosure or any other form of making available, the comparison or interconnection, the restriction, the deletion or the destruction.


The purpose and the legal basis of the data processing

Fiera Bolzano SpA processes your personal data only for the purpose of handling and managing the whistleblowing report you filed. The legal basis of the data processing is your consent to the data processing for the purpose specified above.


The disclosure of personal data

For the abovementioned purposes, the personal data will be disclosed to the following parties:

  • to the public administration and public authorities, if required to do so by law;
  • to service providers, professionals, advisors and other organizations that support us in carrying out our activities.

In the event that the abovementioned parties are charged with the processing of your data by Fiera Bolzano SpA, the data processors will be obliged to adopt all adequate guarantees for the protection of your personal data.


The storage of data

We store your personal data only for the time necessary to treat the report you filed and/or to comply with the legal obligations on data storage. In any case, your data will not be stored for longer than five years from the moment you receive notice of the final finding regarding the report you filed. Thereafter, your personal data will be erased in a secure manner.


Rights of the data subject

You enjoy the following rights:

  • pursuant to Art. 15 GDPR, the right to access your personal data and the respective information. In particular, you enjoy the right to obtain information on the purposes of the processing, on the categories of the processed data, on the categories of parties to which your personal data has been or will be disclosed, on the storage period, on the existence of the right to rectification, erasure, restriction or objection to processing, on the existence of the right to lodge a complaint, on the origins of your data in case your data is not being collected by us, as well as on the existence of automated decision making, comprising profiling, and on the right to obtain significant information on the used algorithm;
  • pursuant to Art. 16 GDPR, the right to have your personal data rectified or, when incomplete, integrated without undue or excessive delay;
  • pursuant to Art. 17 GDPR, the right to erasure of your personal data that is being stored by us, safe for the case in which the processing is necessary for exercising the right to freedom of expression or information, for the compliance with legal obligations, for purposes of public interest or for the ascertainment, the exercise or the defense of a right in court;
  • pursuant to Art. 18 GDPR, the right to have the processing restricted if you contest the accuracy of your data, if the processing of the data is illegal and you object to its erasure, if we do not need the data anymore for the purposes of processing and you need the data for the ascertainment, the exercise or the defense of a right in court, or if you object to the processing pursuant to Art. 21 GDPR;
  • pursuant to Art. 20 GDPR, the right to obtain your personal data in a format that is structured, of common use and machine-readable, and to request the transmission of that data to another data controller;
  • pursuant to Art. 7, Par. 3 GDPR, to withdraw your consent at any moment; as a consequence, we can no longer process your data;
  • pursuant to Art. 77 GDPR, to lodge a complaint to a supervising authority, in specific the authority of the place of residence or work, or of the data controller’s place or residence.
